Jokowi Confirms that the Job Creation Law is still in effect, Has Ordered the Related Ministers to Fix it

“As a democracy based on law, the government respects and immediately implements the Constitutional Court’s decision,” Jokowi said in a video on the Presidential Secretariat’s YouTube channel, Monday (29/11/2021).

The Constitutional Court also ordered the legislators, namely the government and the DPR, to make improvements within two years.

If within two years the law is not amended, it will be declared unconstitutional permanently.

Furthermore, Jokowi said he had ordered the relevant ministers to follow up on the Constitutional Court’s decision.

“I have ordered the coordinating ministers and relevant ministers to immediately follow up on the Constitutional Court’s decision as soon as possible,” said Jokowi. Berita hari ini

Jokowi also emphasized that even though it was declared conditionally unconstitutional, the Job Creation Law was still in effect.

“The Constitutional Court has stated that the Job Creation Law is still in effect. The government and the DPR as legislators are given a maximum of two years to make revisions or improvements.”

“Thus, all the existing implementing regulations for the Job Creation Law are still in effect,” he said.

Government Expects Revision of Job Creation Law to Enter Next Year’s Priority Prolegnas

As previously reported by Tribunnews.com, the government will ask the House of Representatives (DPR) to include the revision of the Job Creation Law (UU) into the national legislation program or priority prolegnas for 2022.

[This is in accordance with President Joko Widodo’s mandate regarding the decision of the Constitutional Court (MK) against Law Number 11 of 2020 concerning Job Creation.

“The government together with the DPR RI will also revise the Job Creation Law and the Law on the formation of laws and regulations in the context of harmonization and the formation of the implementation of the Job Creation Law in the future,” explained Coordinating Minister for Economic Affairs, Airlangga Hartarto, in a virtual press conference, Monday (29/29/2020). 11/2021).

Furthermore, President Joko Widodo will also deliver a letter to the leadership of the DPR to include the revision of the two laws in the priority prolegnas for next year.

For information, the deadline for revising the Job Creation Law is two years after the Constitutional Court’s decision takes effect.
